The Newstead Town Board is weighing conditions for granting a special-use permit and site plan for a home-based business on Maple Road that has drawn complaints from some neighbors. LEDtube At its work session Monday, board members outlined the conditions they are considering for Outdoor Pleasures, a landscaping and construction business operated by Paul Herberger, of 7463 Maple Road. A number of Maple Road residents, including next-door neighbors David and Kathleen Balser, voiced complaints during a public hearing in April relating to drainage, traffic, and dumping and burning of debris at Herberger's property. The Balsers also were at Monday's work session. In response to those complaints, town officials visited the site and met with Herberger before devising some conditions on the special-use permit and site plan. Cummings said those conditions include a 6- foot-high privacy fence to screen vehicles and materials stored on- site; installation of a drainage ditch; and banning "dumping or burning of inappropriate materials" covered by state Department of Environmental Conservation regulations. Board members noted that under the town's law on home-based businesses, no more than 25 percent of a homeowner's property can be used for a business operation, which includes parking for commercial and private vehicles. Cummings said the board likely would act on Herberger's applications during its July 12 meeting. In other business at the work session, the board informally agreed that it would like to add a seventh bay to the public works facility it is building with the Village of Akron on Clarence Center Road near Hake Road. No action is expected before July 12, when the Town and Village boards will meet separately.
